Acceptance of Terms

By downloading, installing, or using any iOS application (collectively, "the Apps") developed and published by CCT Plus LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Apps.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for your personal, non-commercial use, subject to these Terms and all applicable laws.

Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the Apps
  • Remove any copyright, trademark, or other proprietary notices from the Apps
  • Use the Apps for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Apps or related systems
  • Interfere with or disrupt the Apps or servers or networks connected to the Apps
  • Use the Apps to transmit any harmful code, viruses, or malicious software
  • Violate any applicable laws or regulations while using the Apps

In-App Purchases and Subscriptions

Purchases

Some features of the Apps may require in-app purchases or subscriptions. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

Subscriptions

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscriptions and turn off auto-renewal in your Apple ID account settings
  • No refunds will be provided for the unused portion of any subscription period

Pricing

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscriptions until the next renewal period.

Refunds

All purchases are final. Refund requests must be made directly through Apple's App Store in accordance with Apple's refund policies.

User Content

If the Apps allow you to create, upload, or share content:

  • You retain ownership of your content
  • You grant us a license to use, store, and process your content solely to provide the Apps' functionality
  • You are responsible for your content and must ensure it does not violate any laws or third-party rights
  • We reserve the right to remove any content that violates these Terms

Intellectual Property

The Apps, including all content, features, functionality, designs, logos, and trademarks, are owned by CCT Plus LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

Privacy

Your use of the Apps is also governed by our Privacy Policy. By using the Apps, you consent to the collection and use of information as described in our Privacy Policy.

Disclaimers

As-Is Basis

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee

We do not guarantee that:

  • The Apps will be uninterrupted, secure, or error-free
  • The results obtained from using the Apps will be accurate or reliable
  • Any errors in the Apps will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCT PLUS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Apps
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Apps
  • Any bugs, viruses, or other harmful code that may be transmitted through the Apps
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available through the Apps

Indemnification

You agree to indemnify, defend, and hold harmless CCT Plus LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Apps
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or conduct on the Apps

Termination

We may terminate or suspend your access to the Apps immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Apps will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the Apps and updating the "Last Updated" date. Your continued use of the Apps after changes are posted constitutes acceptance of the modified Terms.

Changes to the Apps

We reserve the right to:

  • Modify, suspend, or discontinue the Apps or any features at any time
  • Update or change the Apps without notice
  • Remove or add features or functionality

Third-Party Services

The Apps may contain links to or integrate with third-party services (such as the Apple App Store). We are not responsible for the content, privacy policies, or practices of any third-party services.

Apple-Specific Terms

As the Apps are distributed through the Apple App Store, you acknowledge that:

  • These Terms are between you and CCT Plus LLC, not Apple
  • Apple has no obligation to provide maintenance or support for the Apps
  • Apple is not responsible for any claims relating to the Apps
  • Apple is a third-party beneficiary of these Terms and may enforce them

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Apps shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CCT Plus LLC regarding the Apps and supersede all prior agreements and understandings.
